Tap Dot Heroes Terms of Service

Chapter 1. General Provisions

Article 1 (Purpose)

These Terms govern the rights, obligations, and responsibilities of DynamiteGames (the “Company”) and users in connection with the mobile game “Tap Dot Heroes” (the “Game”) and related services (the “Services”).

Article 2 (Definitions)

1. “User” means a person who uses the Services. 2. “Content” means in-game currency, items, functionality, and other digital materials. 3. “Paid Content” means Content purchased through an App Marketplace. 4. “App Marketplace” means a platform such as Google Play or the Apple App Store that distributes the Game and processes payments. 5. “Platform Account” means an account provided by an external platform such as Google or Apple. 6. “Game Data” means progress, owned currency and items, purchase entitlements, and information generated through use of the Services.

Article 3 (Company Information)

The Company will provide legally required company name, business information, address, customer support channel, Privacy Policy, and these Terms through the App Marketplace, the Services, or a linked page.

Article 4 (Effect and Amendment)

The Company will post these Terms in the Services or on a linked page. Amendments will generally be announced at least seven days in advance, and unfavorable or material amendments at least 30 days in advance, stating the effective date, changes, and reasons. Where required by law, the Company will obtain separate consent. Users who do not agree may exercise rights available under applicable law.

Article 5 (Formation and Application)

The Game may be used without a separate Company membership account. If a particular feature is actually provided and requires an external Platform Account or network connection, the Service will state that requirement. The relevant platform’s terms apply to the Platform Account. The Company may restrict use to the extent necessary for legal violations, breach of these Terms, abuse, or serious operational or security issues.

Article 6 (Other Rules)

Matters not covered by these Terms are governed by applicable laws of the Republic of Korea and generally accepted practices. Mandatory rights of users under the laws of their country or region are not limited.

Article 7 (Operational Policies)

The Company may establish Operational Policies necessary to implement these Terms and will post them in the Services or on a linked page. Material changes affecting users’ rights or obligations follow Article 4.

Chapter 2. Personal Information and Game Data

Article 8 (Personal Information)

The Company processes personal information under applicable law and its separate Privacy Policy. Information processed by Google, Apple, or other external services may be governed by those providers’ policies. The actual categories, retention periods, and deletion methods are stated in the Privacy Policy.

Chapter 3. Obligations of the Company and Users

Article 9 (Company’s Obligations)

The Company will comply with applicable law and these Terms and use reasonable efforts to provide stable Services, security, and support. Nothing in these Terms excludes liability that cannot lawfully be excluded.

Article 10 (User Obligations)

Users must not manipulate Game Data; use cheats, macros, or hacking; exploit bugs; make unauthorized purchases or use another person’s payment method; infringe rights; disrupt the Services; copy, distribute, or reverse-engineer without authorization; or commit fraud or unlawful acts. This Article does not assume that chat, boards, guilds, or nickname systems are provided when they are not.

Chapter 4. Use and Restrictions

Article 11 (Provision)

The Services consist of features actually provided, which may include gameplay, Content, advertising, or Paid Content. Features and Content may change through updates. If randomized Content is offered, odds will be made available before purchase.

Article 12 (Use)

Use may require supported devices, operating systems, and network access. Telecommunications charges are the user’s responsibility. Changing a device, operating system, or Platform Account may affect saving, restoration, or access to Content; the supported scope will be stated in the Services.

Article 13 (Modification and Discontinuation)

The Company may modify the Services for operational, technical, security, or legal reasons and will give advance notice of material changes. If the Services are discontinued in full, the Company will, absent special circumstances, announce the date, reasons, and treatment of Paid Content at least 30 days in advance. Refunds for unused Paid Content or Paid Content with remaining validity are governed by Article 22, Paragraph 3, and applicable law.

Article 14 (Information Collection)

The Company may process information necessary for providing the Services, verifying payments, analyzing errors, and security in accordance with law and the Privacy Policy. These Terms do not assume that the Company collects or retains chat records; actual collection is stated in the Privacy Policy.

Article 15 (Advertising)

The Company may display advertisements within the Game Services in connection with operating the Services. The Company does not send advertising information by push notification.

Advertisements or links provided by third parties may connect users to external services. Such services are outside the Company's control and are governed by the relevant provider's policies.

Article 16 (Intellectual Property)

Rights in the Game, software, images, music, designs, and Content belong to the Company or lawful rights holders. Users receive only the right to use them as necessary to use the Services and acquire no ownership.

Article 17 (Paid Content)

Price, contents, duration, and conditions are shown before purchase. Whether Content is consumable, time-limited, or non-consumable and whether it remains available after purchase follows the product description. Restoration follows the platform and the Game’s actual support; consumables may not be restorable. Cross-platform sharing or restoration is not guaranteed. Auto-renewal, if any, is stated before purchase.

Article 18 (Restrictions)

For breach of Article 10, abuse, security threats, or legal reasons, the Company may take necessary measures, including warnings, removal of improperly obtained Content, or temporary or permanent restrictions, considering the nature, severity, repetition, and applicable law.

Article 19 (Procedure)

The Company will generally state the reason, measure, duration, and challenge method. Urgent security or harm-prevention measures may be taken first with notice afterward.

Article 20 (Challenges)

Users may challenge a restriction through the support channel shown in the Services. The Company will provide the result within a reasonable period. The actual support channel is [TO BE CONFIRMED].

Chapter 5. Payments and Refunds

Article 21 (Payment)

Payments for Paid Content are processed through the applicable App Marketplace. Payment errors, unauthorized charges, and refund requests follow the App Marketplace procedure and applicable law.

Article 22 (Withdrawal and Refunds)

1. Users may request withdrawal or a refund within the periods and under the conditions provided by applicable law.

2. Statutory exceptions may apply where digital Content has begun to be supplied or has been used in a manner that cannot be reversed. Where applicable, the Company will disclose the exception before purchase and obtain any legally required consent or confirmation.

3. If a refund is required for unused Paid Content or remaining validity due to discontinuation or the Company’s responsibility, it will be handled under applicable law and the payment platform’s procedures.

4. For Google Play or Apple App Store purchases, users may first use the platform’s refund process; this does not limit statutory rights.

5. Separate statutory rights apply to defective Content, Content that differs from its description or advertising, and unauthorized charges.

Article 23 (Overpayments)

Overpayments will be refunded under applicable law and the payment platform’s procedures. Costs caused by the user may be borne by the user to the extent permitted by law.

Chapter 6. Termination and Liability

Article 24 (Termination and Data Deletion)

Users may stop using the Services by deleting the Game or ceasing use. These Terms do not assume a separate Company account. Deletion depends on where data is stored. Device data, Google Play Games saved games, iCloud/CloudKit data, and data separately held by the Company may require different deletion processes; actual methods and retention periods are stated in the Privacy Policy and Service screens. These Terms do not promise or assume automatic deletion after one year of inactivity. Data required to be retained by law may be retained for that period.

Article 25 (Damages)

Liability for damages is governed by applicable law. The Company does not limit liability for willful misconduct, gross negligence, or liability that cannot be limited by law.

Article 26 (Disclaimer)

To the extent permitted by law, the Company is not responsible for failures caused by events beyond reasonable control, including disasters, war, telecommunications failures, or platform outages. Statutory consumer protections are not excluded.

Article 27 (Notices)

Notices may be made through Service notices, linked pages, or platform notifications. Where individual notice is required, the Company will use methods and contact details actually available under applicable law. Any separate Company contact address is [TO BE CONFIRMED].

Article 28 (Governing Law)

These Terms are governed by the laws of the Republic of Korea. Where mandatory laws of the user’s place of residence apply, rights under those laws are not limited, and jurisdiction follows the courts designated by applicable law.

Article 29 (Complaints and Dispute Resolution)

Users may submit questions, complaints, or dispute-resolution requests through the support channel shown in the Services. The Company will provide a result or timetable within a reasonable period. The actual channel is [TO BE CONFIRMED]. Users may use external procedures, including consumer dispute mediation, available under applicable law.
